I’m Fera Toricka — an artist, illustrator, and vtuber. I love drawing fantasy characters: expressive, alive, with stories behind their eyes. I enjoy creating pieces where you can feel the personality, where the character looks like they could step out of the frame.I work calmly and attentively — details, atmosphere, and authenticity matter to me. I draw inspiration from DnD, cozy streams, people’s stories, and games you can get lost in for a while.I can create fantasy characters, furry/anthropomorphic characters, and portraits — all in my own style, including adaptations of anime or cartoon characters.I do not draw pornography, sexualized content, robots/mecha, or characters in a purely classic anime style.If you enjoy soft fantasy vibes and characters with heart, you’re in the right place.

I. General Terms / Общие положения

The following rules outline how I — Fera Toricka — accept commissions, receive payment, create illustrations, and deliver the finished work. By placing an order, the client confirms that they have read and agreed to these terms.┈┈┄┄╌╌╌╌┄┄┈┈⌬┈┈┄┄╌╌╌╌┄┄┈┈Ниже указаны правила, по которым я — Fera Toricka — беру заказы, принимаю оплату, выполняю иллюстрации и передаю готовые работы. Оформляя заказ, клиент подтверждает, что ознакомился с этими условиями.

II. Payment / Оплата

1. How Payment WorksFor standard illustrations, a two-step payment system is used: 50% prepayment before starting the sketch and 50% after the final work is completed, before delivering the final file.If the commission is initially requested as a sketch-only work, full prepayment is required.2. Work StagesI start working only after receiving the first payment. If the payment has not been made, the order is not considered confirmed.After the sketch is approved and the first payment is received, I continue working on the final illustration. The final file is delivered after receiving the second half of the payment.3. Payment Methods• International clients: via lava.top (supports PayPal)
• Russian clients: bank transferFees from payment systems are covered by the client.4. Cancellations and RefundsRefunds are possible before the sketch is approved. After the sketch has been approved, refunds are not available.If the brief (specifications) is changed after the sketch is approved, additional payment may apply, which will be discussed in advance.┈┈┄┄╌╌╌╌┄┄┈┈⌬┈┈┄┄╌╌╌╌┄┄┈┈1. Как вносится оплатаДля обычных иллюстраций используется двухэтапная схема: 50% предоплата до начала скетча и 50% после завершения работы, перед отправкой финального файла.Если работа изначально заказывается как скетчевая, то используется полная предоплата.2. Этапы работыЯ приступаю к работе только после получения первой части оплаты. Если оплата не поступила, заказ не считается подтверждённым.После утверждения скетча и внесения первой оплаты продолжаю работу над финалом. Финальный файл отправляется после получения второй половины оплаты.3. Способы оплаты• Зарубежные клиенты: через lava.top (работает с PayPal).
• Российские клиенты: перевод на банковскую карту.Комиссии платёжных систем оплачивает клиент.4. Отмена и возвратыВозврат возможен до утверждения скетча. После утверждения скетча возврат невозможен.Если ТЗ меняется после утверждённого скетча — возможна дополнительная плата, обсуждаемая заранее.

III. Deadlines / Сроки

1. Completion TimeSketches are usually completed within 3–5 business days after receiving the first payment.The final illustration takes approximately 7–14 business days, depending on complexity and size.For large or custom orders, deadlines are discussed in advance.2. Approval and RevisionsAfter the sketch is delivered, the client may request up to 3 free revisions.Additional revisions are charged according to the Additional Elements rules.The final work is completed after the sketch is approved and feedback is received.3. Possible DelaysIf a delay occurs due to my fault, I will notify the client in advance and agree on a new deadline.If the client delays feedback or payment, the deadlines are automatically adjusted.4. Rush OrdersCommissions marked as “rush” are processed with priority.Other commissions continue in the usual order, but their deadlines may be slightly adjusted.If there are multiple rush orders at the same time, they are completed in the order of payment.The number of rush orders may be limited to maintain quality.Details about rush orders and additional fees are agreed upon with the client in advance.┈┈┄┄╌╌╌╌┄┄┈┈⌬┈┈┄┄╌╌╌╌┄┄┈┈1. Время выполненияСкетч обычно готов в течение 3–5 рабочих дней после внесения первой части оплаты.Финальная иллюстрация занимает примерно 7–14 рабочих дней, в зависимости от сложности и объёма работы.Для крупных или нестандартных заказов сроки обсуждаются заранее.2. Утверждение и правкиПосле скетча клиент может внести до 3 бесплатных правок.Дополнительные правки оплачиваются согласно правилам Additional Elements.Финальная работа выполняется после утверждения скетча и получения обратной связи.3. Возможные задержкиЕсли задержка возникает по моей вине, я заранее предупреждаю и согласовываю новый срок.Если клиент задерживает обратную связь или оплату, сроки автоматически смещаются.4. Срочные заказыЗаказы с пометкой “срочно” обрабатываются в первую очередь.Остальные заказы продолжают выполняться в обычном порядке, но их сроки могут немного сдвинуться.Если одновременно есть несколько срочных заказов, они выполняются по очереди в порядке оплаты.Количество срочных заказов может быть ограничено, чтобы сохранить качество работы.Уточнения по срочности и дополнительная плата оговариваются заранее с клиентом.

IV. Use of Work / Использование работы

1. CopyrightAll copyrights to the illustration remain with me, the artist.I reserve the right to use the finished artwork in my portfolio, on social media, and in promotional materials, as well as to share the work process and WIP (work in progress), unless otherwise agreed with the client in advance.The artwork is created as a unique commission for the client and will not be resold or transferred to third parties.2. Client LicenseThe client receives a perpetual non-exclusive license to use the artwork for personal purposes, including but not limited to: avatars, social media usage, personal use in games, and other non-commercial projects.This license cannot be revoked as long as the client complies with these Terms.Any commercial use (advertising, resale, monetization, or use in commercial projects) requires a separate license and must be agreed upon in advance.3. Restrictions and Prohibited UseThe client may not modify the content of the artwork, sell, or resell it without my permission.
Technical adjustments such as cropping, resizing, or file compression are not considered modifications.Any public use of the artwork must include proper credit to the artist, unless otherwise agreed in advance.The artwork may not be used for:• NSFW content, pornography, or depictions of violence;• propaganda, discrimination, or any illegal activities;• training AI, generative models, or similar systems without my consent;• advertising or commercial projects without a previously agreed commercial license.┈┈┄┄╌╌╌╌┄┄┈┈⌬┈┈┄┄╌╌╌╌┄┄┈┈1. Авторские праваАвторские права на иллюстрацию принадлежат мне, художнику.Я сохраняю право использовать готовую работу в своём портфолио, социальных сетях и промо-материалах, а также публиковать процесс работы и WIP (work in progress), если иное не было согласовано с клиентом заранее.Работа создаётся как уникальная комиссия для конкретного клиента и не перепродаётся третьим лицам.2. Лицензия для клиентаКлиент получает бессрочную неисключительную лицензию на использование иллюстрации для личных целей, включая, но не ограничиваясь: аватар, оформление социальных сетей, личное использование в играх и других некоммерческих проектах.Данная лицензия не отзывается, если клиент соблюдает условия настоящих правил.Любое коммерческое использование (реклама, продажа, монетизация, использование в коммерческих проектах) требует отдельной лицензии и обсуждается заранее.3. Ограничения и запрещённое использованиеЗапрещено изменять содержание работы, продавать или перепродавать её без моего согласия.
Технические изменения (кадрирование, изменение размера, сжатие файла) не считаются редактированием.Любое публичное использование работы должно сопровождаться указанием авторства, если иное не было согласовано заранее.Работа не может использоваться:• для NSFW-контента, порнографии, сцен насилия;• для пропаганды, дискриминации или любых незаконных действий;• для обучения ИИ, генеративных нейросетей или аналогичных систем без моего согласия;• в рекламе или коммерческих проектах без предварительно согласованной лицензии.

V. Liability / Ответственность

I complete the work to the highest possible quality and within the agreed deadlines, but I do not take responsibility for any consequences arising from the client’s use of the illustration.The client decides independently how to use the work, including publication, printing, resale, or any other application.I am not responsible for delays or issues caused by payment systems or third-party services.┈┈┄┄╌╌╌╌┄┄┈┈⌬┈┈┄┄╌╌╌╌┄┄┈┈Я делаю работу максимально качественно и в срок, но не несу ответственности за последствия использования иллюстрации клиентом.Клиент сам решает, как использовать работу, включая публикацию, печать, перепродажу или любое другое применение.Я не отвечаю за задержки или проблемы, возникшие по вине платёжных систем или сторонних сервисов.

VI. Exceptional Cases / Сложные случаи

1. Unforeseen Circumstances on My SideIf I am unable to complete the commission on time due to illness, personal circumstances, or technical issues, I will notify the client in advance and agree on a new deadline or the option to cancel the order with a refund of any payment already made.2. Unforeseen Circumstances on the Client's SideIf the client delays payment, does not respond to messages, or fails to provide necessary materials, deadlines are automatically extended.If the client cancels the order before the sketch is approved, a partial or full refund may be issued depending on the situation.3. General ProvisionsNeither I nor the client are responsible for force majeure circumstances, including natural disasters, internet outages, issues with payment systems, and similar events.Any changes to deadlines or conditions in such cases are agreed upon in writing or via electronic communication.┈┈┄┄╌╌╌╌┄┄┈┈⌬┈┈┄┄╌╌╌╌┄┄┈┈1. Непредвиденные обстоятельства с моей стороныЕсли я не могу выполнить заказ в оговоренные сроки по причине болезни, личных обстоятельств или технических проблем, я уведомляю клиента заранее и согласовываю новый срок или возможность отмены заказа с возвратом уже внесённой оплаты.2. Непредвиденные обстоятельства с клиентской стороныЕсли клиент задерживает оплату, не отвечает на сообщения или не предоставляет необходимые материалы, сроки автоматически переносятся.Если заказ отменяется клиентом до утверждения скетча, возможно частичное или полное возвращение предоплаты в зависимости от ситуации.3. Общие положенияНи я, ни клиент не несём ответственности за форс-мажорные обстоятельства, включая стихийные бедствия, отключения интернета, проблемы с платёжными системами и т.п.Все изменения сроков или условий в таких случаях согласовываются письменно или через электронную переписку.
